These Terms & Conditions (“Terms”) govern your use of https://vitasphereonline.com (“the Website”) and any purchase you make from it. The Website is operated by VITASPHERE ONLINE, a business registered in the United Republic of Tanzania (BRELA Business Registration No. 616399, TIN 107-286-985), of Plot 15, Block 15, House No. 15, Mabatini Road, Kijitonyama Ward, Kinondoni District, Dar es Salaam 14113 (“we”, “us”, “our”, “Vitasphere Online”).
By browsing the Website, creating an account, or placing an order, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund & Returns Policy. If you do not agree, please do not use the Website.
1. Definitions
- “Products” means the goods offered for sale on the Website, including Norland health and wellness products and VMAX365 Tea & Coffee beverages and related items.
- “Order” means your request to purchase Products through the Website.
- “You” / “Customer” means the person browsing the Website or placing an Order.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under Tanzanian law to place an Order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.
3. Your account
You may need to create an account to order. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at admin@vitasphereonline.com if you suspect unauthorised use. We may suspend or close accounts that breach these Terms, provide false information, or are used for fraud.
4. Products and descriptions
We take care to describe and picture Products accurately, but packaging, colours and formulations may vary, and images are for illustration. Products are subject to availability and we may change or discontinue any Product at any time.
Norland products. We sell genuine Norland products as an independent distributor. Norland products are dietary supplements and wellness items. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Always read the label and consult a qualified healthcare professional before use, especially if you are pregnant, breastfeeding, taking medication, or have a medical condition.
VMAX365 Tea & Coffee. VMAX365 beverages and ice cream are freshly prepared to order at the VMAX365 outlet at Shamo Tower, Mbezi Beach, New Bagamoyo Road, Dar es Salaam. They are perishable food items available for pickup or local delivery within Dar es Salaam only, cannot be shipped elsewhere, and cannot be returned or refunded once prepared (see the Refund & Returns Policy). Drinks may contain milk, caffeine, nuts, soy or other allergens – ask us about ingredients before ordering if you have an allergy or dietary restriction.
5. Prices
All prices are shown in Tanzanian Shillings (TZS) and include any applicable Value Added Tax. Delivery charges are shown separately at checkout before you pay. If we discover that a Product was mispriced after you order, we will contact you to confirm the correct price or cancel the Order and refund you in full.
6. Orders – offer and acceptance
Your Order is an offer to buy. A contract is formed only when we send you an order confirmation or dispatch the Products, whichever is earlier. We may decline or cancel an Order if the Product is unavailable, the price or description was wrong, we cannot verify your details or delivery area, payment is not received, or we reasonably suspect fraud. If we cancel a paid Order, we refund you in full.
7. Payment
You can pay using the methods shown at checkout, currently mobile money via AzamPay (Airtel Money, Mixx by Yas, HaloPesa, Azampesa and M-Pesa) and direct bank transfer. Payments are processed by our payment providers; we do not receive or store your mobile-money PIN or full bank credentials. Your Order will not be dispatched until payment has cleared. For bank transfer, use your Order number as the reference and send proof of payment if requested.
8. Collection and delivery
We prepare your Order for collection from Norland Tanzania, Mabatini Road, Sinza AfricaSana, House No. 15, Dar es Salaam. You are responsible for arranging and paying for transport – whether you collect in person or send a Bolt, boda boda or courier. Vitasphere Online does not charge for delivery, does not act as a carrier, and is not responsible for loss, damage or delay once your Order has been handed to you or to a rider you sent. Risk in the Products passes to you at the point of collection.
9. Cancellations, returns and refunds
Your rights to cancel, return Products and receive refunds are set out in our Refund & Returns Policy, which forms part of these Terms. Certain Products – including all VMAX365 food and drinks and opened supplements or personal-hygiene items – are non-returnable for health and safety reasons.
10. Promotions and vouchers
Discount codes and promotions are subject to their own terms, cannot be exchanged for cash, may be withdrawn at any time, and may not be combined unless stated.
11. Intellectual property
All content on the Website is owned by or licensed to Vitasphere Online and is protected by law. “Norland” and “VMAX365” and their logos are trademarks of their respective owners. You may not copy or reuse any content for commercial purposes without our written permission.
12. Acceptable use
You agree not to use the Website unlawfully, to introduce malware, to attempt unauthorised access, to scrape or resell content, to place fraudulent Orders, or to post unlawful, defamatory or misleading content.
13. Reviews and user content
If you submit a review, you confirm it is your own honest opinion and does not infringe anyone’s rights. You grant us a non-exclusive, royalty-free licence to use and display that content in connection with the Website. We may edit or remove content that breaches these Terms.
14. Third-party services and links
The Website integrates or links to third-party services (for example AzamPay for payments, Google for analytics, delivery partners, and the Norland and VMAX365 platforms). We are not responsible for their content, policies or availability.
15. Disclaimers and limitation of liability
The Website is provided “as is” and “as available”. To the fullest extent permitted by Tanzanian law, we exclude implied warranties not expressly stated here. Nothing limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total liability for any Order is limited to the amount you paid for that Order, and we are not liable for indirect or consequential loss.
16. Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of these Terms or misuse of the Website or Products.
17. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control, including strikes, transport disruption, power or network failure, floods, fire, disease outbreaks, or acts of government.
18. Changes to these Terms
We may update these Terms from time to time. The version published here when you place an Order applies to that Order.
19. Governing law and disputes
These Terms are governed by the laws of the United Republic of Tanzania, and you and we submit to the exclusive jurisdiction of the courts of Tanzania sitting in Dar es Salaam. Please contact us first – we would always prefer to resolve any problem directly.
20. General
If any part of these Terms is unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. These Terms, with the Privacy Policy and Refund & Returns Policy, are the entire agreement between you and us regarding your use of the Website.
